Terms and Conditions of Use and Sale (T&C)
1. LEGAL INFORMATION AND SCOPE
1.1 Publisher and Host The web platform and application accessible at https://oopsia.com (hereinafter the "Platform" or "Oopsia") are published and managed by Plaerus Studios, a company registered and based in Thailand (hereinafter the "Service Provider"). Registered office: 191/93 M.1 Surasak, Sriracha, Chonburi 20110, Thailand. Support contact: hello@oopsia.com Hosting: Vercel Inc., 340 S Lemon Ave #4133, Walnut, CA 91789, USA. 1.2 Definitions User: Any natural person browsing the Platform or using its free features. Customer: Any natural person purchasing a paid Pass. Parties: Jointly refers to the User/Customer and the Service Provider. 1.3 Enforceability and Modifications These T&C govern, without restriction, access to the Platform, the use of games and features, as well as all financial transactions concluded between the Parties. The Service Provider reserves the right to amend these provisions at any time. Modifications take effect immediately upon their publication online and apply to any subsequent access or purchase.
2. CONDITIONS OF ACCESS AND AGE OF MAJORITY
Access to the Platform, account creation, and use of services are STRICTLY RESERVED FOR ADULTS (18 years of age and older). By browsing the Platform or subscribing to an offer, the User confirms under their sole responsibility that they are at least 18 years old (or have reached the legal age of majority in their country of residence). The Service Provider reserves the right to immediately block or delete access to any profile suspected of violating this age restriction.
3. RULES OF USE, ETHICS, AND PLAYER SAFETY
Oopsia is an entertainment tool designed to explore intimacy within a couple. The use of the Platform is subject to strict and unconditional compliance with the safety rules below: 3.1 Mutual and Explicit Consent The consent of each participant must be free, informed, and continuous. Each player retains the absolute and inalienable right to refuse or interrupt any action, dare, or proposal in the game at any time, without needing to provide any justification. 3.2 Safe Word Users formally agree to establish a "Safe Word" by mutual agreement before starting any game. If either player says this word, the game or current action must stop immediately and permanently. 3.3 Impaired Faculties and Sobriety The Platform must be used in a safe and healthy environment. Users agree to participate in the games in full possession of their physical and mental faculties, without having consumed alcohol, drugs, or any other substance that may impair their judgment or prevent them from giving informed consent. 3.4 Disclaimer Regarding Player Behavior The Service Provider solely provides a digital game medium. The actual execution of the suggested activities is the sole responsibility of the Users and relies on their common sense. The Service Provider shall not be held liable for any physical, moral, or material damage resulting from inappropriate use or failure to comply with the aforementioned ethical rules.
4. PRICING AND PAYMENTS
Access to the entirety of the premium content requires the prior payment of an access fee. 4.1 Access Plans All plans offered are one-time payments, with no automatic renewal and no recurring billing. 24H Pass: Grants access to premium content for twenty-four (24) hours from the moment the payment is confirmed. Lifetime Pass: Grants permanent access to premium content, including games added at a later date. 4.2 Currency and Amounts Prices are displayed in euros for Customers residing in a eurozone country, and in US dollars for all other countries. The currency applied is the one displayed at the time of payment. 4.3 Payment Methods and Security The processing and security of banking transactions are handled by our certified partner, Stripe. The Service Provider does not store and never has access to the Customer's credit card details. 4.4 Invoices The Customer may review their purchases and download their invoices at any time via the Customer Portal, which is directly accessible within the application.
5. REFUND POLICY
Given the intangible nature and instant delivery of digital content (access is unlocked immediately after payment confirmation by Stripe), NO REFUND OR CREDIT will be issued once access to premium games or services has been unlocked. The Customer expressly acknowledges and accepts this condition before completing their purchase.
6. INTELLECTUAL PROPERTY AND LICENSE TO USE
6.1 Reservation of the Publisher's Rights All elements constituting the Oopsia Platform — including but not limited to its architecture, graphic design, texts, game ideas and concepts, features, interfaces, visuals, logos, and source codes — are the exclusive property of Plaerus Studios. 6.2 Restrictions on Use The Customer is granted a personal, temporary, non-exclusive, and non-transferable right to access the Platform's content. Without prior written consent from Plaerus Studios, the following are strictly prohibited: - Any reproduction, copying, distribution, or broadcasting of all or part of the concepts, texts, or graphic elements. - Any decompilation, reverse engineering, or extraction of the source code. - Any direct or indirect commercial exploitation of the application or its content.
7. LIABILITY AND TECHNICAL LIMITATIONS
The Service Provider employs reasonable means to ensure the proper functioning of the Platform. However, this remains an obligation of means. The Service Provider declines all liability regarding: - Service interruptions due to maintenance operations or outages caused by the hosting provider (Vercel) or the internet network. - Any failures during the payment process managed by the third-party provider (Stripe). - Loss of access due to incompatible hardware or software on the User's end.
8. CUSTOMER SERVICE AND SUPPORT
Technical support and account management are handled exclusively via electronic means. For any request for assistance relating to access, a purchase, or the operation of the application, the User may contact the support team at the following address: hello@oopsia.com.
9. APPLICABLE LAW AND JURISDICTION
These Terms and Conditions of Use and Sale are governed by, interpreted, and enforced in accordance with the laws of the Kingdom of Thailand. Any dispute or disagreement relating to the validity, interpretation, execution, or breach of these T&C shall be subject to the exclusive jurisdiction of the courts of the Kingdom of Thailand, regardless of the User's country of residence or the location from which the Platform was accessed.
